For payers of Romanian corporate income tax, within the limits of the law. Details below.
For sponsors that pay Romanian corporate income tax, sponsorship is not treated as an ordinary deductible expense; it may instead be deducted from the corporate income tax due, within the limit set by the Fiscal Code — usually the lower of 0.75% of turnover and 20% of the corporate income tax due.
If the annual limit is not fully used through direct sponsorships, redirecting corporate income tax through form 177 may be considered. Companies making sponsorships should also check their obligation to file form 107.
For micro-enterprises, ASDBNP promises no tax benefit: the mechanism previously applicable to this category must be verified explicitly for the year in which the sponsorship is made.
This information is indicative and does not constitute tax advice. The final treatment is determined by the sponsor's own accountant or tax adviser, according to their tax regime and the legislation in force at the date of the sponsorship.
